RESOLUTION ENACTING ORDINANCE NO. 2010 - 01

WHEREAS, a Budget hearing was conducted on  December 11,2009 for legislative authorization in the amount of NINETY THREE MILLION FOUR HUNDRED TWENTY NINE THOUSAND ONE HUNDRED EIGHTY FOUR AND SIXTY CENTAVOS (P93,429,184.60) for the General Fund and ELEVEN MILLION  FIVE HUNDRED SIXTY THOUSAND SIX HUNDRED SEVENTY PESOS AND FOURTY FIVE CENTAVOS (P11,560,670.45) for the Special Account;

WHEREAS, during the Budget Hearing with the Department Heads of the herein offices: the Municipal Budget Office, Municipal Sports Office, and Sangguniang Bayan agreed to transfer a portion of their appropriations as shown below;

RESOLUTION ENACTING ORDINANCE NO. 2010 – 02

WHEREAS, Resolution no. 2009 – 257  adopted as the Official Hymn of the Municipality the Opol the hymn composed by the Hon. Mayor Dixon Q. Yasay and the Music Arranged by the  Exodus Band of Cagayan de Oro City on July 6, 2009;

WHEREAS, to show love, respect and patriotism to the Municipality of Opol, residents should know by heart the Opol Hymn;

WHEREFORE, on motion presented by Kag. Chizarina M. Ortigoza and seconded by Kag. Edgar V. Cortez; it was

RESOLVED AS THE BODY HEREBY RESOLVES, to Enact:

ORDINANCE NO. 2010 – 02

AN ORDINANCE REQUIRING THE SINGING OF OPOL HYMN AFTER THE SINGING
OF THE NATIONAL ANTHEM IN THE PROGRAM, ACTIVITY OR EVENT IN THE
MUNICIPALITY OF OPOL, MISAMIS ORIENTAL

BE IT ORDAINED by the Sangguniang Bayan of Opol, that:

Section 1. Regulatory Act.     The Opol Hymn composed by the Hon. Mayor Dixon Q. Yasay and the Exodus Band of Cagayan de Oro City shall be sung after the singing of the National Anthem in the Program, Activity or Event in the Municipality of Opol, Misamis Oriental. 

Section 2.  Administrative
Provision.     It is the duty of the head of office and even organizer to see to it that the singing of the hymn shall be rendered right after the singing of the National Anthem, such as but not limited to flag ceremonies in schools, barangays, sessions of the Sangguniang Bayan and Sangguniang Barangays.

In any other program, activity or event, Opol Hymn may be sung prior to the end of such program, activity or event in the Municipality of Opol.

Section 3.  Penalty.     Any person who is found guilty or disrespecting the Opol Hymn shall be punished by a fine of P1,500.00 or an imprisonment of two (2) days or both fine and imprisonment upon the discretion of the court. 

Section 4.  Effectivity.     Upon the approval by the Local Chief Executive.

WHEREAS,  the Local Government of Opol is committed to empower communities for the protection of their rights as may be affected by the projects introduced that could be environmentally and socially critical as to its impact;

WHEREAS,  there is a need to establish the requirements for the issuance of a Resolution of Social Acceptability to prevent any undue delays which may adversely affect investors to put up their investments in the Municipality;

WHEREFORE, on motion presented by Kag. Lynn Amor L. Paclar-Panulaya and seconded by Kag. Romulo J. Ebonia; it was

RESOLVED AS THE BODY HEREBY RESOLVES to Enact:

ORDINANCE NO. 2010 – 03

AN ORDINANCE PROVIDING FOR REQUIREMENTS FOR THE ISSUANCE OF SOCIAL ACCEPTABILITY ON APPLICATIONS BY PROJECT PROPONENTS IN THE
MUNICIPALITY OF OPOL
BE IT ORDAINED by the Sangguniang Bayan of Opol, that:

SECTION 1.  TITLE.     That this Ordinance shall be known as, “THE SOCIAL ACCEPTABILITY
ORDINANCE OF THE MUNICIPALITY OF OPOL”. 

SECTION 2.  PURPOSE.    It will strengthen public participation and social acceptability
requirements in such as way that it will empower communities for the protection of their rights as may be affected by the projects introduced that could be environmentally and socially critical as to its impact. 

SECTION 3.  COVERAGE.    This Ordinance provides for the requirements for the issuance by the Sangguniang Bayan of Social Acceptability on the following projects:

a)      Sand and Gravel application
b)      Construction/setting up of Poultries, Piggeries, Slaughterhouses, Plans, Factories and
other critical projects/establishments including its expansion.
c)     Construction of Cellular Phone Sites/Towers including its relay base stations that could give adverse effect to the environment.

d)    Foreshore Lease application which requires for its Environmental Compliance Certificate
(ECC), resolution of Social Acceptability from the LGU affected. 
e)    Housing Projects and application for simple subdivision of lots which includes social
acceptability as requisite for the approval of Subdivision Plans before the Department of Environment and Natural Resources (DENR), Land Management Bureau (LMB).
f)    Other projects and/or activities considered as environmentally critical. 

Applications for small scale mining are not anymore covered in this Ordinance being provided by
the Small Scale Mining Ordinance of Opol. 

SECTION 4.  DEFINITION OF TERMS.  As used in this Ordinance, the following terms shall mean:

A)    Social Acceptability – refers to the acceptance of a project by affected communities based on timely and informed participation in the assessment process with particular regard to environmental and social impacts that are of concern to them.

B)    Resolution of Social Acceptability (Barangay Level) – is a Resolution issued by the Barangay Council concerned with attached documentation of the process, which is to be based on public participation, undertaken to secure the consent of the affected communities to the project, whether or nor such consent is actually secured.

C)    Resolution/Certification on Social Acceptability (Sangguniang Bayan level) -  shall refer to the act of the Sanggunaing Bayan of Opol, signed by at least the majority of its members, supporting and interposing no objection to the application of the proponents of the projects enumerated in Section 3, after all the requisites of public consultation has already been complied with.

D)    Proponent -  refers to persons, whether natural or juridical, owners/agents, organizations or other entities planning, proposing or otherwise undertaking a project, program or policy, including government agencies, government-owned and controlled corporations and Local Government Units.

E)    Project -  means activities including actions, programs or undertakings, regardless of magnitude, which may have significant impact on the environment.

F)    Environmentally Critical Projects (ECP) -  refer to all projects declared as environmentally critical, or those which have high potential for creating negative impacts on the environment and to the safety and health of persons and their quality of life, due to the nature of the project and the activities to be done pursuant to its implementation.

G)     Free and Prior Informed Consent (FPIC) -  shall mean the consensus of all members of the affected Cultural Communities (Lumads) consenting to the implementation of a project being proposed and undergoing environmental assessment, free from any external fraud, manipulation, interference or coercion, and obtained after fully disclosing the intent and scope of the project, in a language and process understandable to the “Lumads” affected. 

SECTION 5.  PROHIBITED ACT/S.  It shall be prohibited for each project proponent to construct, set-up or establish the projects as enumerated in Section 3 without the Resolution of Social Acceptability issued by the Sangguniang Bayan.

SECTION 6.  REQUIREMENTS FOR THE ISSUANCE OF RESOLUTION OF SOCIAL ACCEPTABILITY.  No Resolution/Certification for Social Acceptability shall be released to the applicants without compliance with the following requirements:

a)    Letter of application signed by the applicant/s or its representative in case the applicant is
a corporation, organization or other legal entity.

b)    Public Consultation in the area applied for:

i)    Minutes of public hearing with the constituents that may be affected in the project
introduced;
ii)    Attendance Sheet with the signatures of the participants in the said public hearing;
and
iii)    Photo documentation of the said activity. 

c)    Resolution of the Barangay Council concerned interposing no objection to the project
and/or activities.

d)    Sketch plan and vicinity map of the area applied for

e)    An Affidavit of Undertaking to be executed by the proponent to conduct activities for the
rehabilitation of the area affected by the project such as but not limited to road rehabilitation, community assistance in case of calamities and other dire needs, tree planting along the project vicinity and other activities relating thereto.

f)    In case of areas within ancestral lands, the applicant shall secure “free and prior informed
consent” (FPIC) to the cultural communities concerned.

g)    Certification from the Municipal Planning and Development Office that the project/s
conforms to the Comprehensive Land Use Plan and Zoning Ordinance of the Municipality. 

SECTION 7.  COMMITTEE HEARING.      The applicant shall, within ten (10) days after submitting all the above requirements before the Sangguniang Bayan shall be made to appear to a Committee Hearing to be conducted by the Chairman of the Committee concerned for further deliberation and presentation of additional documents, if there be any required.

SECTION 8.  PENALTY.    Violators of this Ordinance specifically to the provisions of Section 5 hereof, shall be subject to the following penalties:

First Offense     PhP300.00 or 1 month imprisonment or both at the discretion of the court

Second Offense             PhP500.00 or 2 month imprisonment or both at the
discretion of the court

Third  and subsequent offenses     PhP1,000.00 or 4 months imprisonment or both at the
discretion of the court

Three (3) violations of this Ordinance shall be ground for cancellation of the business permit in cases of poultry, piggery and slaughterhouse owners and for the refusal of the Municipality to issue business permit and/or renew the same as the case may be.

SECTION 9.  NON-COMPLIANCE BY THE PROPONENT OF HIS UNDERTAKING.     Within one (1) year after the grant of Social Acceptability by the Sangguniang Bayan in favor of the proponent, the Barangay Council concerned shall conduct an inspection of the area to

verify as to compliance by the proponent/permitee of its signed Affidavit of Undertaking as required by Section 6 (e) of this Ordinance.

The Barangay Council concerned then shall make a report, copy furnished the Office of the Municipal Mayor and the Sangguniang Bayan of Opol as to compliance or non-compliance of the permittee of his Affidavit of Undertaking.  Such report will then be evaluated by the Sangguniang Bayan for action. 

Should the Sangguniang Bayan find that there has been non-compliance by the proponent of his/her undertaking, the Sangguniang Bayan shall issue a Resolution revoking its Social Acceptability Resolution with the effect of nullifying it ab initio as if no Resolution for Social Acceptability was issued.

Such Resolution nullifying the formerly issued Social Acceptability shall be forwarded to the Agency requiring the Social Acceptability with recommendation that the project be closed/ceased.

The said recommendation shall be without prejudice to the revocation of any licenses and permits issued by the LGU-Opol in favor of the project proponent such as but not limited to, Business Permit, Building Permit, etc.

SECTION 10.  The Municipal Engineer’s Office and the Municipal Planning and Development Office are tasked with the proper and vigorous implementation of this Ordinance. 

SECTION 11.  SEPARABILITY CLAUSE.  If, for any reason or reasons, any parts or provision of this ordinance shall be declared unconstitutional or invalid, other parts or provisions thereof not affected shall continue to be in full force and effect.

SECTION 12.    REPEALING CLAUSE.  All existing Ordinance/s or Resolution/s inconsistent herewith are hereby repealed. 

SECTION 13.  EFFECTIVITY CLAUSE.  The Ordinance shall take effect thirty (30) days after it shall be passed in review by the Sangguniang Panlalawigan of Misamis Oriental.

WHEREAS, on November 3, 2009, a letter request was forwarded before the Office of the Sangguniang Bayan pertaining to the reclassification of the above described properties owned and tax declared in the name of Lolita Nabo and Sps. Francisco Bacayana and Anastacia Maglangit;

A RESOLUTION ENACTING ORDINANCE NO. 2010 - 12

WHEREAS, Section 11, Article XIII of the 1987 Constitution, declares that the State shall adopt an integrated and comprehensive approach to health development which shall endeavor to make essential goods, health and other social services available to all the people at affordable cost. There shall be priority for the needs of the underprivilege, sick, elderly, disabled, women and children. The State shall endeavor to provide free medical care to paupers;

WHEREAS, Republic Act 7277, otherwise known as the Magna Carta for Persons with disabilities, expressly provides that persons with disabilities shall be given rehabilitation, opportunities for self development and self-reliance to prepare them for full integration into the mainstream society;

WHEREAS, Republic Act No. 8425, otherwise known as the Social Reform Act provides for the poverty alleviation of the basic sectors, including persons with disabilities;

WHEREAS, the BIWAKO Millennium Framework which promotes aright-based, Barrier free and inclusive society for persons with disabilities is supported by Proclamation No. 240 “Declaring the period 2003-2012 as the Philippine Decade of Persons with Disabilities;

WHEREAS, Republic Act 7160 known as the Local Government Code of 1991 mandates the devolution of the services of the Local government Unit;

WHEREAS, there is a need at the community level for an effective approach in providing comprehensive rehabilitation services and in promoting the rights and empowerment of persons with disabilities;

WHEREAS, the Community Based Rehabilitation approach has been successfully demonstrated as an appropriate way of providing comprehensive rehabilitation services to person with disabilities nationwide;

WHEREAS, Executive Order No. 437 dated June 21, 2005 issued by then President Gloria Macapagal-Arroyo, explicitly encourages all LGUs to:

a.    Adopt the Community Based Rehabilitation (CBR) strategy in delivering services to their constituents with disabilities and to allocate funds to support the program;

AN ORDINANCE SUPPORTING THE SITE DEVELOPMENT AND IMPLEMENTATION OF THE OPOL TEENS HEALTH QUARTERS (THQ), A SOCIAL FRANCHISE MODEL DEVELOPED BY THE FOUNDATION FOR ADOLESCENT DEVELOPMENT, INC. (FAD, INC.) WITH FUNDING SUPPORT FROM THE OFFICE OF CONGRESSMAN YEVGENY EMANO, DOH & POPCOM REGION 10, GERMAN EMBASSY AND LOCAL GOVERNMENT UNIT OF OPOL, MISAMIS ORIENTAL.


WHEREAS, the Philippines under the 1987 constitution stresses that one of the commitments of the State is the strengthening of the family as a basic social institution and by virtue of this, the Philippines entered into and made commitments under the Declarations of the 1994 International Conference on Population and Development (ICPD) and the Fourth World Conference on Women in 1995 where  it recognizes the importance of addressing the sexuality and fertility issues of both men and women of reproductive age and the need to give emphasis on population welfare;

WHEREAS, the National Government through Executive order No. 307 acknowledges the need for the “Full support and active involvement of the local government units (LGUs) to implement the Philippine Family Planning Program Nationwide” and enjoins LGU through DILG Memorandum Circular No. 88-47 to “organize/establish functional local population development

committees” and “to mobilize the private sector and other non-government organizations to actively participate in the local population welfare programs” toward this end;

WHEREAS, Her Excellency, President Gloria Macapagal-Arroyo made a public announcement that her administration’s population and family planning policy would be consistent with the four (4) basic principles, namely: (i) responsible parenthood, (ii) respect for life, (iii) birth spacing, and (iv) informed choice;

WHEREAS, the UN Millennium Development Goals includes: Goal No. 3 Promote Gender Equality and Empower Women: Goal No. 6 Combat HIV/AIDS, malaria and other diseases;

WHEREAS, in the recently held International Conference on Reproductive Health Management (ICRHM), emphasis was given on the importance of Adolescent Sexuality and Reproductive Health:

WHEREAS, A declaration crafted by the youth delegates during the ICRHM was presented to Senator Rodolfo Biazon as Co-Chairperson of the Philippine Legislative Committee on Population Development (PLCPD) in the Senate.

WHEREAS, in the ICRHM youth declaration, the youth delegates are demanding that the National Government, Legislators, Local Government Units respect their right to access information about their Reproductive Health Rights; Facilities and services dedicated to young adolescents be made available and accessible.

WHEREAS, according to the Young Adult Fertility and Sexuality Study (YAFS), 1/5 or 16.5 million Filipinos belong to 15-24 years old age group or adolescents; 30% of all births belong to age 15-24; 25% are already mothers at age 20; 16% of 400,000 induced abortion per year are by teeners; 62% of reported STs belong to ages 15-24; 62% of newly reported HIV-AIDS infections belongs to 15-24 years old.

WHEREAS, according to the National Youth Commission Ten Million Filipinos (10,000,000) are engaged in drugs and seventy percent (70%) are within the age group of 15-24;

WHEREAS, the Foundation for Adolescent Development, Inc. (FAD, Inc.), a private, non-profit, non-government organization, duly organized and existing under the virtue of the laws of the Philippines, with principal office address at 1066 Remedios corner San Bartolome Sts. Malate, Manila, has embarked on a project dubbed as “teens Healthquarters (THQ) Social Franchise Model Project”

WHEREAS, FAD Inc. developed the THQ Social Franchise Model in the last (8) eight years with eleven (10) franchises located in Baguio City (Baguio Center for Young Adults), Dasmariñas, Cavite (De LaSalle), Marikina City (LGU), Tarlac City (LGU), Sagada, Mountain Province (LGU), Municipalities of Carmen, Talibon & Ubay, Bohol (LGU)

WHEREAS, Teens Healthquarters (THQ) aims to provide “a center that makes accessible to young people (13-24) information-education, values clarification and behavior modeling as well as select medical services relevant to sexuality, reproductive health and development needs, managed by youth friendly, competent professionals and volunteers”.

WHEREAS, THQ will also provide counseling and referral network.

WHEREAS, The Municipal Government of Opol through its Local Chief Executive- Hon. Dexter B. Yasay, Congressman – Hon. Yevgeny Emano, DOH-POPCOM Region 10, German

Embassy, City Councilors and Municipal Health Office in partnership with FAD, intends to provide a THQ for the youth of Opol;

WHEREAS, the THQ Transfer of Technology will include the materials on Franchisee Operation and Training, Educational and Promotional Materials, Transfer of Technology Training, Initial Marketing and Branding Assistance, Monitoring the Maintenance of Standard Operations and Access to future materials that will be develop by the foundation, Endorsement to FAD Referral Partners and Donors and Access to skills enhancement trainings as made available to FAD;

WHEREAS, the Municipal Government shall provide the License fee, site and its improvement, equipment for medical, dental and educational service, Personnel, Expenses of Opol THQ personnel during the THQ transfer of Technology Training, Monthly Operating expenses, and Membership Fee;

WHEREAS, the THQ License Agreement between the Municipal Government and FAD, Inc. will be for a period of two (2) years, during which FAD, Inc. will continuously provide technical assistance;

WHEREAS, the Municipal Government and FAD, Inc. will have to agree after the initial two years if they are to continue with the relationship;

WHEREAS, Opol is one of the fastest growing Municipal in Misamis Oriental. Thus, the exigency for a project that will address the Adolescent Sexuality and Reproductive Health needs of the youth of Opol that will focus on education through values formation with special focus on preventive education, availability of youth friendly medical services both general and reproductive health, counseling and referral network;

NOW, THEREFORE, be it ORDAINED by the Municipal Council of Opol, in session duly assembled, the following:

WHEREAS, there is a need for the OCC to have a separate campus;

AN ORDINANCE DECLARING 3,116 SQ.M. PART AND PARCEL OF LOT KNOWN AS OPOL PUBLIC PLAZA WITH LOT # 5037 LOCATED AT BARANGAY POBLACION, MUNICIPALITY OF OPOL AS THE SITE OF OPOL COMMUNITY COLEGE.

BE IT ORDAINED by the Sangguniang Bayan of Opol, that :

Section 01. An area of 3,116 sq.m. and bounded by the perimeter Municipal Road of this municipality is hereby declared as educational developmental area.

Section 02. The Public Plaza owned by Municipal Government of OPOL under TD #0815000100414 with an area of 9,983 sq.m.

Section 03. This Educational Developmental Area is the most conducive to learning, bounded in the NORTH by Municipal Road known as P. Maape St. and in the EAST by another Municipal Road known as C. Salva St. and on the SOUTH by Municipal Road S. Vacalares St. and on the WEST by M. Salva St.

Section 04. Prohibited and Punishable Acts
The following acts are considered violation of this ordinance:
a.    Construction of any other building within the premises of Public Plaza
